Accident claims question:

my 18 yr old son got off a bus and a car overtaking hit him, he suffered a fractured skull and a bleed from the brain, has liver damage and other injuries too, the woman was a disqualified driver with no insurance but the police are saying it's my sons fault for not looking before he crossed? my son nearly died through these head injuries and is now being told he can't claim compensation because it was his fault, even though that woman should never have been behind the wheel at all, if you could help/advise me what to do next i would be grateful, thankyou

I am sorry to hear of the terrible injuries that your son has suffered. Cases like this are difficult and much depends on the individual circumstances of each case, the positioning of your son, whether the driver of the car had seen him, where the bus had stopped and so on. Very often the Police will decide not to recommend criminal prosecution of motorists involved in accidents like your son's. However, the civil law is based upon different legal principles and it is often possible for a civil claim for damages to be pursued, even when there is no criminal action against the motorist. Each case will depend upon its own facts, though, so it is important to take advice from a solicitor who is experienced in dealing with serious road traffic accidents.

The Motor Insurers' Bureau (MIB) will meet any claims against uninsured or untraced motorists who cause road traffic accidents, so do not be put off by the fact that the motorist was uninsured.

Your son will need substantial rehabilitation to make the best recovery from his injuries and interim payments are usually available in strong cases to cover the cost of rehabilitation, care, loss of earnings, new accommodation etc.
