Employment question:
I have been off sick. Can my employer insist that the time off sick counts as part of my holiday –so, in effect, I lose holiday?

The answer in ‘no’. Time whilst you are off sick does not count towards your annual holiday entitlement.
Suppose you take 10 days holiday and are sick for three of them. Provided you give the proper sick notes, etc to your employer, then you can claim those three days as time off whilst sick, and therefore claim another 3 days of holiday.
