If your son has already returned the Acknowledgment of Service following service upon him of the divorce petition it may be too late to contest the position on costs. If not, he should suggest to his wife's solicitors that he will make it a condition of his admitting adultery (by answering 'Yes' to the question in the Acknowledgment) that they drop any claim for costs against him. If they refuse (because they already have evidence of adultery) he may need to rethink the strategy and consult a lawyer.
