Family and relationships question:

my wife has offered to buy me out with a lump sum before the divorce reaches the decree nisi stage ...should I be suspicious of this? The offer asked me to sign over my share of the house & was on an open letter with no mention of consent order.What disavantages are there to me signing this or advantages to not signing? Thank you.

Yes be suspicious, be very suspicious. It may be that the proposal is the best way forward but have you valued the total assets you and your wife currently own to include pensions. The starting off point for anything other than a short marriage is a 50:50 split. Do you achieve that by signing over the house for a lump sum? Are you sure the price is right? And even if it ,is make sure the deal becomes part of a court order, which if it is in your interests to do so, makes it clear that the transfer proposed is in full settlement of all claims your wife may have against you - a clean break. Simply signing the house over now without a court order leaves you open to defending further claims in the future. I have just met with a poor old chap in his seventies whose solicitors failed to get him a 'clean break' in his divorce 28 years ago - his ex-wife is now claiming half his pension. Don't fall into that trap!
