Employment question:

I am working for a company for more than 5 years but unfortunately i got ill and off sick for a while and i went back to work again and i was working in the the same department then my lung collapsed and i was unable to do much physical job and went to depression as well and i asked for change of department but i am waiting for 2 years to change my department but they are not helping me out and says there is no vacancy but they are recruiting more people in the same department where there is no vacancy for me and in may last year i had a thyriod problem and i went off sick and later in october 11 they gave me health care care leave and i am still home but i thought i should another job and applied for other job and recently i got a good job offer in another company and there was only a reference check to do to start my new job but now i received an email from new company that they are unable to give me a job because they they received an unfavourable reference from my employer i am no where now could u give me an advice what should i do now? ill and was off from work

Your query is quite complex as it contains many strands to it. I am unclear as to whether or not you are still with your employer?

There may be issues surrounding discrimination on the grounds of a potential disability. However, I would require more details about your illness and how long it may last.

If you are disabled within the meaning of the Equality Act 2010, then an employer has a duty to make reasonable adjustments to assist you in returning back to work.

There is also a potential issue about why you received an unfavourable reference - could it be due to your absence levels and if this is related to your disability, then there are further issues to be looked at.
