Family and relationships question:

My husband and I have split up but we don’t want to drag ourselves through the court. We’ve heard of a new procedure called Collaborative Law. What is this and is it a viable alternative?

Good Lawyer Guide's response

Collaborative Law is quite a new process which is used to sort out family disputes away from the courts. Basically, you would each appoint your own lawyer and you would meet up with your lawyers to discuss various issues face to face.
This process isn’t right for everyone but it’s worth considering if you want to reach an agreement that puts your children’s needs first, you want to keep legal costs down, keep things amicable between you and you want to keep control over the financial matters and the arrangements involving your children.
Alternatively, you could try mediation where a mediator talks to both sides and helps you come to satisfactory decisions on the important issues involved, particularly relating to children. Both options are preferable to a nasty court battle which can prove expensive and causes a complete breakdown in the relationship between you both.
